These Terms and Conditions apply to users availing the services provided by NGMB Software Solutions Pvt. Ltd. ("NGMB") through its platform and the Touch&Pay application. Each user is deemed to have read, understood, and accepted these Terms and Conditions before accessing or using the services.

Acceptance of Terms

The Terms and Conditions contained herein shall apply to the user availing services of NGMB for making payments through the platform. Each user is therefore deemed to have read and accepted these Terms and Conditions.

Changes to Terms and Conditions

By continuing to access or use NGMB's services, the user will be deemed to have agreed to and be bound by any altered, added, or deleted Terms and Conditions.

If the user does not agree to any alteration, addition, or deletion to these Terms and Conditions, the user should discontinue accessing or using NGMB's services.

User Information and Payments

The user may enter their details and credentials as required and make payments through any convenient payment channel made available by NGMB from time to time on the platform.

Eligibility

In order to access and use NGMB's services, the user must be an individual of at least 18 years of age and capable of entering into legally binding contracts under applicable law.

In the case of a corporation, trust, association of persons, partnership, firm, or other legal entity, the user accessing the services must be duly authorised to agree to these Terms and Conditions and to access, use, and avail NGMB's services on behalf of such entity.

Lawful Use

The user warrants that they will not use the services provided by NGMB for any purpose that is unlawful, fraudulent, abusive, or prohibited by these Terms and Conditions.

The user agrees to comply with all applicable local, state, national, and international laws and regulations and shall be solely responsible for all acts and omissions arising from their use of the services.

Compliance with Applicable Laws

The user is solely responsible for understanding and complying with all applicable laws and regulations of any specific jurisdiction in connection with their use of NGMB's services.

Such laws and regulations may include, where applicable:

  • Applicable Reserve Bank of India (RBI) guidelines and directions relating to payment systems, Payment Aggregators and Payment Gateways.
  • Payment and Settlement Systems Act, 2007.
  • Prevention of Money Laundering Act, 2002 (PMLA) and applicable rules.
  • RBI Master Direction – Know Your Customer (KYC) and applicable amendments.
  • Bharat Connect Central Unit Procedural Guidelines and applicable Business Standards.
  • Information Technology Act, 2000 and applicable rules and regulations.
  • Any other applicable laws, regulations, guidelines, circulars, directions, or regulatory requirements.

The above requirements shall apply to the user to the extent applicable to the services being used and the user's activities.

Service at User's Risk

The user expressly agrees and understands that NGMB's services are availed at the user's sole risk.

To the extent permitted by applicable law, the services are provided on an "as is" and "as available" basis without warranties other than those expressly provided by NGMB.

Limitation of Liability

To the maximum extent permitted by applicable law, NGMB shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, or other damages arising out of or relating to the use of, or inability to use, the services.

This may include, without limitation, loss of profits, loss of revenue, loss of business, loss of data, business interruption, or other economic or consequential losses, except where such liability cannot legally be excluded or limited under applicable law.

Upon receiving an account deletion request, we may verify the identity of the requester before processing the request. This is done to protect customer accounts and prevent unauthorized deletion requests.

After verification, eligible account information will be deleted or anonymized in accordance with our applicable policies and legal obligations.

Data Retention

Certain information may be retained where required by law, regulatory requirements, financial record-keeping obligations, fraud prevention, dispute resolution, security requirements, or other legitimate legal purposes.
